Referral Partner Policy

Introduction

Affable IT LLC ("Affable IT" or "we") is pleased to offer our Referral Partner Program to incentivize individuals and businesses to refer potential clients to our managed services. This policy outlines the terms and conditions of the program, including the referral bonuses, eligibility criteria, and restrictions.

1. Referral Bonuses

1.1 Referral Partner Compensation:

• On-boarding Fee: Referral Partners will receive 50% of the on-boarding fee paid by the referred client.

• Monthly Recurring Revenue (MRR): Referral Partners will receive 5% of the original MRR for the duration of the contract with the referred client.

• Additional Services: Referral bonuses are based solely on the on-boarding fee and original MRR. No additional bonuses will be provided for any extra services sold to the referred client.

1.2 Bonus Conditions:

• Referral bonuses will cease if the referred client’s contract is canceled, terminated, or renewed at the end of the original contract term.

• Referral bonuses are only payable for contracts signed within 12 months of the referral introduction.

2. Referral Partner Eligibility

2.1 Exclusions:

• Referral Partners cannot be owners, management, or decision-makers at the company they are referring.

• Individuals or entities in the following fields are excluded from participating in the Referral Partner Program:

• Realtors
• Lawyers and Law Offices
• Medical professionals (including nursing, chiropractic, dental, or naturopathic practitioners)

2.2 Referral Process:

• Referrals must be submitted through the official Affable IT referral form or process.
• Each referral must be accompanied by the necessary contact details and information to be considered valid.

3. Existing Customer Referral Bonus

3.1 Referral Bonus for Existing Customers:

• Existing customers who refer a new client will receive a referral bonus equivalent to one (1) times the first month's MRR as a credit to their current account with Affable IT LLC.
• The same exclusions as outlined in section 2.1 apply to existing customers.

3.2 Credit Application:

• Referral credits will be applied to the existing customer’s account within 30 days of the referred client's contract activation.
• Credits are non-transferable and must be used within 12 months of issuance.

4. Anti-Kickback Compliance

4.1 Regulatory Compliance:

• All referral bonuses and credits are subject to applicable anti-kickback laws and regulations.
• Affable IT LLC reserves the right to review and adjust the Referral Partner Program to ensure compliance with such laws.

5. Termination and Modifications

5.1 Program Termination:

• Affable IT LLC reserves the right to modify or terminate the Referral Partner Program at its discretion with 30 days' written notice.

• In the event of program termination, referral bonuses for existing referrals will be honored in accordance with the terms outlined above.

5.2 Policy Changes:

• Affable IT LLC may update this policy periodically. The latest version will be available on our website or provided directly to current referral partners.

6. General Terms

6.1 Non-Exclusivity:

• Participation in the Referral Partner Program does not create an exclusive relationship or partnership between Affable IT LLC and the referral partner.

6.2 No Employment Relationship:

• Referral partners are independent entities and not employees or agents of Affable IT LLC.

6.3 Dispute Resolution:

• Any disputes arising from the Referral Partner Program shall be governed by the laws of the state where Affable IT LLC is incorporated, and disputes will be resolved through binding arbitration.
